However, the case lacked critical evidence—most notably, Suzanne’s remains—and the prosecution struggled to move forward. Just days before the trial was set to begin in April 2022, the charges were dropped without prejudice, leaving the door open for future prosecution if new evidence surfaced.


The Breakthrough in the Case:

That turning point arrived in September 2023, when Suzanne’s remains were discovered in a remote part of Saguache County. Forensic analysis revealed the presence of a sedative blend known as BAM, commonly used in wildlife tranquilization. This became a pivotal piece of evidence, especially since Barry had access to such substances through his work as a deer farmer.

Renewed Charges with New Evidence:

With this new information, a grand jury was convened again. On June 20, 2025, Barry Morphew was re-indicted and arrested in Arizona. He is currently being extradited to Colorado to face trial. The renewed case is built on updated forensic findings, inconsistencies in Barry’s phone and vehicle data, and suspicions that Suzanne’s body may have been relocated after her death.
