But the most important thing is that the product you are advertising and the claims you are making in that advertisement, is it really that effective? If it is, then no one can stop you from selling that product, but suppose there is a company which is promoting its product a lot in its advertisement but the claims it is making are wrong, then the government will take action against your product. And for this the government will first check the product and see whether something else is actually being said in the advertisement but the product is doing something else. So in such a case the government can ban that company and its products.

But what if such things are happening but the government is not taking any action on it. Recently, one such case is in the news across the country and this is the case of Patanjali. Actually, on 27 February, the Supreme Court has completely banned Patanjali from health related advertisements due to false advertisement, but what is the whole matter behind this? Patanjali company was started in 2006 by Acharya Balkrishna and Baba Ramdev under the name "Patanjali Ayurveda". If we talk about ownership, then 94% ownership of this company is in the name of Acharya Balkrishna and the remaining 6% ownership is with other investors.

Till 2012, the turnover of this company was 450 crores, which increased to 5000 crores in 2015 and with this the turnover of the company increased to 31000 crores in 2023. But there is a big reason behind the increase in its turnover -

The first reason is that Patanjali products - Today, more than 900 Patanjali products are available in the market in different categories like - Healthcare, Beauty Wellness, Food items, Packages food, Cosmetics, Personal care, which are being sold indiscriminately.

The second big reason is its advertisement - Actually the advertisement of Patanjali product is done at a different level. Because its brand ambassador is Yoga Guru Ramdev, people blindly believe every claim made by him. People say that whatever Baba Ji is saying, he must be right, but the claims made by people in his products are not completely correct. Many of their claims have been proven wrong, I am going to tell you about them in the next video.

The third big reason is price which matters most to people to buy any product. If you have gone to buy biscuits and you belong to a middle class family, then you would think that it would be better to buy biscuits which are a little cheaper and because of this, Patanjali's products are sold more than other products because they are cheaper than other companies. are comparatively a bit cheaper. Now I am not saying this, you yourself must have observed these things.

The fourth big reason is government support - If you are getting support from the government then you will grow very fast and the same things have happened with Patanjali also. No matter how many products Patanjali is doing false advertising, it has no fear that action can be taken against it. And that is why the Supreme Court had given notice to Patanjali last year that you should stop doing false advertisements otherwise you will have to pay a fine of Rs 1 crore for each false advertisement. But even after this, the company did not obey the order of the Supreme Court and continuously showed false and misleading ads, due to which on 27 February, the Supreme Court bench banned all the health related ads of Patanjali and Patanjali Ayurved and its Managing Director Acharya Balkrishna. Issued a contempt notice against Patanjali because Patanjali's AIDS were violating the Drugs and Magic Remedies (Objectionable Advertisements) Act 1954.

So let us first know how this false advertisement case started. So see, not only from today, Patanjali has been making many such claims for many years which only mislead people and its purpose is only to sell more and more Patanjali products. If you look at the history, you will find that since 2015 till now, Patanjali has been embroiled in controversies many times, yet today this company has become one of the largest FMCG company in India.

In August 2022, the Indian Medical Association filed a petition in the Supreme Court. In this petition, Indian Medical Association said that Patanjali is spreading misinformation against allopathy and modern medicine. It was said in the petition that Patanjali clearly wrote in an advertisement “MISCONCEPTIONS SPREAD BY ALLOPATHY: SAVE YOURSELF AND THE COUNTRY FROM THE MISCONCEPTIONS SPREAD BY PHARMA AND MEDICAL INDUSTRY,”. 

In November 2023, the bench of Supreme Court judges Ahsanuddin Amanullah and Prashant Kumar Mishra, while hearing the petition of the Indian Medical Association, said that Patanjali has run a "Defamation campaign" against modern medicine and the Covid-19 vaccination drive.

After this, the Supreme Court strongly reprimanded Patanjali and gave strict instructions that the company should immediately stop running such false and misleading advertisements, otherwise after this a fine of Rs 1 crore will be imposed on the company for each misleading advertisement. The date of this hearing was 21st November.

But even after this, Patanjali made similar false claims, which was again complained to the Supreme Court and then the Supreme Court banned all the health related ads of Patanjali. Because Patanjali's AIDS were violating the Drugs and Magic Remedies (Objectionable Advertisements) Act 1954.

So let us once again know the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 so that we can know why the Supreme Court has banned Patanjali's products citing this Act. So Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 is an act made in the Indian Parliament which controls all types of drugs i.e. medical aids in India. Along with this, this Act also bans those medicines and remedies which claim that their medicines and remedies have magical properties. Under this Act, there are a total of 54 such diseases on which you cannot claim that your medicine has completely cured these diseases.

Because diseases like BP sugar have not ended even today, once the person gets this disease, he will have to take medicine for the rest of his life or will have to abstain from it. And till date no such treatment has been discovered either in allopath or in Ayurveda. And that is why the aids given by Baba Ramdev violate this Act.

During the hearing on February 27, the court told that the Supreme Court had on November 21 told the company that it would neither make any “casual statements” in print or electronic media regarding the efficacy of its medicinal products nor allopathy. Anyone will make derogatory statements on subjects like medicine.

But the very next day of the hearing, on 22 November, Ramdev once again held a press conference and promoted his medicines.

Justice Hima Kohli and Justice Ahsanuddin Amanullah said that the company and Balkrishna have approached the Supreme Court on November 21, 2023 to stop them from advertising or branding their products as "permanent relief" for diseases like obesity, blood pressure, asthma etc. Has violated the assurance given and has also violated the Drugs and Magic Remedies (Objectionable Advertisements) Act 1954.

When the court asked the company how exactly Baba Ramdev is connected to Patanjali, the company's lawyer gave a vague answer and said that he is a yoga guru and sannyasi.

After this Justice Amanullah told the government representative Additional Solicitor General K.M. Asked Nataraj whether the government has taken any action on the issue of Patanjali advertisement violating the law.

The Supreme Court reprimanded the government and said, “The government is sitting with its eyes closed. The entire country is being misled by such advertisements. For two years you have been waiting for the Drugs Act to ban it. This is very unfortunate. The government will have to take some immediate action.”

On this K.M. Nataraj said that soon the Union (government) will file a detailed affidavit on this, which will reveal what action has been taken on the last order given by the court. Nataraj also said that it is in the hands of the state government to implement whatever provisions are there in the act.

After this, the Supreme Court banned all health related ads of Patanjali and gave 3 weeks time to Patanjali to file its reply.

After the court's rebuke, senior advocate Vipin Sanghi, appearing for Patanjali, assured that the company will not publish any such ad in future. It will also ensure that casual replies are not given in the press.
